Terms of use

1. Purpose

These Terms of Use (ToU) define the conditions of access to and use of the Escale France website and services (hereinafter "the Platform"), published by EI BOUYSSETGROUP. They apply to any visitor or member of the Platform.

2. Acceptance of the terms

Accessing and using the Platform implies full and unreserved acceptance of these ToU. If the user does not accept these terms, they must stop using the Platform. These ToU are available on the site at all times.

3. Account creation

Some features (publishing reviews and photos, favourites, badges, points) require creating an account. The user undertakes to:

• provide accurate, up-to-date and complete information when registering;
• keep their credentials confidential and not share them;
• create only one personal account and not impersonate a third party;
• inform Escale France of any unauthorised use of their account.

Registration is reserved for people aged at least 15. Users may delete their account at any time from their personal area.

4. User content and reviews

Users are solely responsible for the content they publish (reviews, ratings, photos, comments). They undertake to publish authentic content, based on a genuine experience, respectful and compliant with the law.

The following content is prohibited in particular:

• false, misleading or written in exchange for a benefit;
• defamatory, insulting, hateful, violent or contrary to public decency;
• infringing the rights of third parties or privacy;
• promotional, advertising or soliciting in nature.

Escale France reserves the right to moderate, refuse or remove any non-compliant content without notice. Users retain their rights to their content but grant Escale France a non-exclusive, free and worldwide licence to host, display and reproduce this content on the Platform and its communication media.

5. The Escore and rankings

The Escore is an indicative score out of 100, calculated from community reviews (50%), objective data (30%) and our jury's verdict (20%). The rankings derive from it and are updated every week.

The Escore and rankings are provided for information only, as a decision-making aid, and have no contractual value. Escale France does not guarantee their accuracy or completeness.

6. Intellectual property

The Escale France brand, the Escore sign, the logo, the interface, the editorial texts and the structure of the Platform are protected by intellectual property law. Any reproduction or reuse without prior written authorisation is prohibited. These ToU grant the user no ownership right over the Platform.

7. Availability and liability

Escale France uses reasonable means to ensure access to the Platform 24/7, without however guaranteeing uninterrupted availability. Access may be suspended for maintenance or in the event of force majeure.

Information about destinations (opening hours, prices, services) is provided for guidance only. Escale France cannot be held liable for indirect damages resulting from the use of the Platform or the inability to access it. Partner links and services are subject to the terms of those third parties.

8. Suspension and termination

In the event of a breach of these ToU, Escale France may, without notice, remove content, suspend or terminate the account concerned. Users may also terminate their account at any time. Termination does not affect content already published in anonymised form that is necessary for the operation of the rankings.

9. Applicable law and disputes

These ToU are governed by French law. In the event of a dispute, and failing an amicable settlement, the French courts shall have jurisdiction. In accordance with regulations, consumer users may use a consumer mediator or the European online dispute resolution platform: https://ec.europa.eu/consumers/odr

10. Changes to the terms

Escale France reserves the right to amend these ToU at any time to adapt them to changes in the Platform or in regulations. The applicable version is the one in force on the date of use. Users are invited to review them regularly.

11. Affiliate and advertising content

The Escale France website may contain affiliate links and content relating to tourist activities (tickets, tours, experiences), in particular through partners such as GetYourGuide. When a user makes a booking or purchase through these links, Escale France may earn a commission at no additional cost to the user. The site may also offer advertising content or recommendations from advertising partners or local partners. This content does not affect the price paid by the user and is provided for information purposes only.
